OUR FEES

This office considers that cost predictability is a key element when engaging the clients’ matters. The services offered are fairly predictable but could readily result in a lesser or greater amount of work depending on certain circumstances. By reviewing the following list of legal fees and disbursements, the client can make an informed decision before retaining the services offered. After reviewing these fees, you can still give us a call for a free consultation to determine a more accurate quote on your transaction or matter and how this office may help you. If this office cannot assist you, you will be referred to another legal professional

REAL ESTATE

 

PURCHASE                                                                                     $999.00 +HST 


Includes all legal fees, internal office expenses, title searches for a single-family residence and review of Status Certificate (Condominiums) with one mortgage or a secured line of credit from one of the big five banks and includes services rendered in a standard real estate sale transaction and may increase if unforeseen title/off-title complications arise.

Notes:


• Legal fees based on one mortgage to be registered from one of the big five banks and include internal office expenses, title search on a whole of a lot property.


• For condominiums, legal fees include review of status certificate; however, if the status certificate is not provided but required for completion of the transaction, additional disbursement and courier charges may apply.


• Legal fees do not include:


  • Province of Ontario and City of Toronto Government Land Transfer Tax, it will depend on the purchase price and whether the client is considered first time or not; 


  • City of Toronto Municipal Land Transfer Tax administration fee, at a cost of $75.00+HST, if applicable; 


  • Government registration fees ($76.55 for each instrument, usually transfer and mortgage); 


  • Sheriff’s Certificates, which will reveal if there are any judgments registered against you or the vendors. Currently the cost is $11.80 in the City of Toronto and $15.42 outside City of Toronto per person; 


  • Title Insurance, which depends on the purchase price and the mortgage amount to be registered; 


  • Non-Resident Speculation Tax (15% on the purchase or acquisition of an interest in residential property); 


  • Property tax and/or utilities certificates from the municipality where the property is located. 


  • A fee of $165+HST if mortgage instructions are received/revised or there is a lender change within 3 days of closing date.

SALE                                                                                     $699.00 +HST 


Includes all legal fees and internal office expenses for a single-family residence, with one mortgage to be discharged and includes services rendered in a standard real estate sale transaction and may increase if unforeseen title/off-title complications arise.


Notes:


• Legal fees apply regardless of the sale price.


• Legal fees include internal office expenses for a single-family residence with payout/discharge of one mortgage.


• Additional legal fees of $165.00+HST for bridge financing and related disbursements.


• Additional legal fees apply if other secured, unsecured debts or a private mortgage are required to be paid out/discharged and if tenants are to be assumed by the purchaser/s.

MORTGAGE / REFINANCING                                                                       $499.00 +HST 


Includes legal fees and internal office expenses for a single-family residence, with a new mortgage from one of the big five banks and one existing mortgage to be discharged and includes services rendered in a standard real estate sale transaction and may increase if unforeseen title/off-title complications arise.


Notes:

• Legal fees do not include: 

  • Government registration fees of $76.55 per instrument; 
  • Sheriff’s Certificates at a the cost of $11.80 in the City of Toronto and $15.42 outside the City of Toronto per person; 
  • Title Insurance which depends on the mortgage amount to be registered; 
  • Payout/discharge of any other secured or unsecured debts.

TRANSFER OF TITLE / SURVIVORSHIP APPLICATION

$399.00 +HST 


Includes legal fees and internal office expenses.


Notes:


• Legal fees do not include:


  •  Government registration fees of $76.55 per instrument; 
  • Sheriff’s Certificates at a the cost of $11.80 in the City of Toronto and $15.42 outside the City of Toronto per person; 
  • Title Insurance; if applicable.

ADDITIONAL MATTERS NOT INCLUDED IN REAL ESTATE MATTERS 

 

  •  Negotiating and drafting the agreement of purchase and sale either on a resale or new property transaction.


  •  Interim Closing of a new condominium unit, on which additional fees of $250.00 plus HST and related disbursements are to be added. The fees are payable at the time of the interim occupancy date.


  • Enhanced mortgage requirements for a purchase transaction from a 2nd tier lender or additional mortgage to be registered.


  • Assignments of leases and rents and PPSA’s.


  •  Removal of executions and applications to clear title either on a purchase, sale or refinancing transaction.


  • Additional mortgage to be registered on closing.


  • Acting for a non-resident.


  • Private mortgages; purchases or sales of vacant land, multiple units, cottages and commercial properties, for which a custom quote is required.

FAMILY MATTERS

 

UNCONTESTED DIVORCES                                                                        $1,099.00 +HST 


Notes:

  • Includes all legal, Court filing fees and office expenses.
  • Service of Documents/Process Server expenses are to be added as applicable.
  • Retainer is required.



CONTESTED DIVORCES

  • Fees on contested divorces will depend on the number of issues to resolve.

Notes:

  • A will includes both a Continuing Power of Attorney and for property and a Power of Attorney for personal care.

  • In a Simple Will, except for specific bequests, your entire estate will either go to your spouse, or to your children, if your spouse dies before you. If you have a large amount of assets, own a private corporation, or want to do more complicated things, you would need to contact the office for a custom quote.

ESTATES

 

Application for the Certificate of Appointment of Estate Trustee With a Will or Without a Will

Notes:


  • Fees are custom made based on the value of the estate, the responsibility and professional skills required, the difficulty, novelty of the issues and the time involved.
  • Usually the application for a certificate of appointment of an estate trustee, involves reviewing and advising on the deceased's assets and liabilities, the entitlement of creditors, the beneficiaries and heirs, the terms of the will or, if there is no Will, the distribution on intestacy, the duties and rights of the estate trustee; preparing the application for certificate of appointment of estate trustee; preparing documents to transfer assets of the deceased to the estate trustee; advising as to and preparing documents to distribute assets in specie to beneficiaries and to obtain releases of the estate trustee and reporting to the estate trustee in connection with these matters.
  • Estate is also responsible for paying filing applications and estate fees, administration bonds (if required), courier expenses and software transaction charges.
  • Additional matters such as advice about transfer of assets are not included.

  • These fees do not include the drafting of any Affidavit, Statutory Declaration or Document.

  • On any purchase real estate transaction client’s closing funds are to be advanced to the office before registration.
  • Some matters require payment of retainer before commencing work on your behalf.
